1. Agreement to these terms
These Terms & Conditions govern your use of the Aprobify mobile app and this website. By downloading, creating an account, or using Aprobify, you agree to them. If you do not agree, do not use the service.
2. What Aprobify is — and what it is not
Aprobify is an independent study tool for the California DMV written knowledge test. It is not affiliated with, endorsed by, sponsored by, or connected to the California Department of Motor Vehicles or any government agency. Our study material is based on the official California Driver's Handbook (DL 600), but we are not the publisher of that handbook, and the DMV has no involvement in this app.
3. No guarantee of passing, and not legal advice
We work hard to keep our content accurate and aligned with the current edition of the Driver's Handbook, but we cannot guarantee that you will pass any test, that every question mirrors the real exam, or that the material is free of errors. Traffic law changes, and the DMV may update the handbook or the test at any time. Nothing in Aprobify is legal advice. Always confirm anything that matters against the current official handbook at dmv.ca.gov and follow the instructions of the DMV and law enforcement.
4. Eligibility and minors
You must be at least 13 years old to use Aprobify. If you are under 18, you may use it only with the involvement of a parent or legal guardian, and any purchase must be made or authorized by them. By subscribing you confirm you have the legal capacity to enter into this agreement, or that your parent or guardian has agreed to it on your behalf.
5. Your account
You sign in with Google or Apple. You are responsible for keeping access to that account secure and for everything done through your Aprobify account. Tell us at hola@aprobify.es if you believe someone else is using it. One account is for one person: do not share credentials or resell access.
6. Acceptable use
You may use Aprobify to study. You may not: copy, scrape, republish or redistribute our questions, explanations, audio or other content; reverse engineer the app or attempt to bypass payment or access controls; use automated tools to extract content in bulk; or use the service in any way that breaks the law or interferes with other people's use of it. We may suspend or close accounts that do.
7. Subscriptions, billing and auto-renewal
Some features require a paid subscription. Prices are shown in the app in your local currency before you confirm. Payment is charged to your Apple ID or Google account at confirmation of purchase. Subscriptions renew automatically for the same period unless you turn off auto-renewal at least 24 hours before the current period ends. Your account is charged for renewal within 24 hours before the period ends. You manage and cancel subscriptions in your Apple or Google account settings, not in the app — we cannot cancel a store subscription on your behalf.
8. Refunds
Purchases are processed by Apple and Google, and refunds are governed by their policies, not ours. Requests go to Apple Support or Google Play Support. If something on our side went wrong — you were charged for access you did not receive, for example — email hola@aprobify.es and we will help you resolve it with the store.
9. Free trials and promotional access
Where we offer a free trial or promotional access, the terms of that offer are shown at the time. Unless stated otherwise, a trial converts into a paid subscription when it ends unless you cancel before then. We may grant complimentary access at our discretion and withdraw it at any time.
10. Content and intellectual property
The questions, explanations, audio recordings, design and software in Aprobify are ours or licensed to us, and are protected by copyright and other intellectual property laws. Your subscription grants you a personal, non-transferable, non-exclusive right to use them for your own study. It does not transfer ownership of anything. Content reproduced or adapted from the California Driver's Handbook remains subject to the terms under which the DMV publishes it.
11. Service availability and changes
We aim to keep Aprobify available and up to date, but we do not guarantee uninterrupted service. We may add, change or remove features, and we may need to take the service down for maintenance. If we discontinue a paid feature you are actively subscribed to, we will give reasonable notice.
12. Disclaimer of warranties
To the maximum extent permitted by law, Aprobify is provided "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
13. Limitation of liability
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or opportunity, arising from your use of Aprobify — including failing a DMV test. Our total liability for any claim relating to the service is limited to the amount you paid us in the twelve months before the claim arose. Some jurisdictions do not allow these limitations, so parts of this section may not apply to you.
14. Indemnity
You agree to indemnify and hold us harmless from claims, damages and reasonable legal costs arising from your misuse of the service, your breach of these terms, or your infringement of someone else's rights.
15. Termination
You may stop using Aprobify at any time and delete your account from the profile screen. We may suspend or terminate your access if you materially breach these terms, with notice where reasonably possible. Termination does not automatically refund an active subscription; refunds follow section 8.
16. Changes to these terms
We may update these terms as the service or the law changes. We will update the "last updated" date above and, for material changes, notify you in the app or by email before they take effect. Continuing to use Aprobify after that means you accept the updated terms.
17. Governing law and disputes
These terms are governed by the laws of the State of California, without regard to its conflict of laws rules. Before starting formal proceedings, please contact us at hola@aprobify.es so we can try to resolve the matter directly — most issues are settled that way. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in California, and you and we consent to their jurisdiction. Nothing here prevents you from bringing a claim in small claims court where it qualifies.
18. Apple App Store terms
If you obtained Aprobify from the Apple App Store, you acknowledge that this agreement is between you and us, not Apple; that Apple has no obligation to provide maintenance or support; that in the event of a failure to conform to any applicable warranty you may notify Apple for a refund of the purchase price; that Apple is not responsible for any claims relating to the app; and that Apple and its subsidiaries are third-party beneficiaries of this agreement and may enforce it against you.
19. General
If any part of these terms is found unenforceable, the rest remains in force. Our not enforcing a provision is not a waiver of it. These terms, together with the Privacy Policy, are the entire agreement between us regarding the service. You may not transfer your rights under them without our consent.
