If you drive erratically with a BAC below 0.08%, can you be arrested for DUI?
- Yes, if you show signs of impairment — correct answer
- Only if you are under 21
- No, BAC must be 0.08%+
Why
Yes. Below the limit is not the same as safe to drive, and visible impairment is enough for an arrest. (Handbook, Section 9.)
