7.5.4 💸 Financial Responsibility After an Accident.

If you cause serious damage beyond your insurance coverage, you could be personally liable for the excess amount. The injured party can sue you, and if they win a judgment and you don’t pay, your driver’s license may be suspended until the judgment is satisfied.

🛡️ That’s why carrying adequate insurance is so important.


📄 SR-22 for Serious Cases

  • If your license is suspended due to:
    • A DUI, or
    • Being at fault in an accident without insurance,
      you’ll likely need to file an SR-22.
  • An SR-22 is a certificate from an insurance company proving you’re insured.
  • You must maintain the SR-22 for 3 years after reinstatement.

🚫 No Insurance Penalty Recap

  • If you had no insurance at the time of a crash, your license can be suspended for up to 4 years.
  • After 1 year, you may apply for reinstatement if:
    • You get insurance, and
    • You file an SR-22.
  • Then you must maintain the SR-22 for the remaining suspension period.

🤏 What if It’s a Minor Accident?

  • If damages are under $1000 and no one is injured, you:
    • Do not need to file with DMV.
    • Can handle the situation privately through insurance.
  • 🚫 However: Leaving the scene or failing to exchange info is still illegal, regardless of damage amount.

  • If there’s disagreement about fault or damages:
    • Insurance companies may handle it through arbitration.
    • If you’re unsatisfied, you may seek legal advice.
    • Many minor claims get resolved amicably between insurers.
