Topic 3 · Rules of the Road: Traffic Laws in California
A broken-down car is stopped on the shoulder with its hazard lights flashing. What must you do?
- Nothing: the Move Over law only covers police, fire and tow trucks
- Move into a lane away from it if safe, or slow down if you cannot change lanes — correct answer
- Stop and offer assistance
Why
Since January 1, 2026 (AB 390), the Move Over law covers any stationary vehicle displaying flashing hazard lights or a warning device such as cones or flares — not just emergency, tow and road work vehicles.
